    Our fixed fee Family Law services

    During times of change and uncertainty we are here to support you and avoid surprises whenever possible.

    We are able to provide in many circumstances a fixed fee divorce/dissolution of partnership service for both Applicant and Respondent.

    In addition, following divorce when financial arrangements have been agreed either in person or in Alternative Dispute Resolution, we can provide a fixed fee service to draft and submit a Financial Remedy Consent Order Application.

    (All services include opening file procedures, providing terms of business and completing I.D. checks for money laundering regulations.)

    Service fees

    SERVICE FIXED FEE

    General consultation – 1 hour

     

    Providing up to a max. of 60 minutes personal telephone advice. 

    £350 plus VAT

    Applicant in Divorce Proceedings/dissolution of Civil Partnership (unopposed)

     

    Includes one telephone appointment obtaining instructions, drafting and submitting the Application and progressing to Final Order (excludes Defended proceedings or responding to answers filed/objections to costs; personal service or alternative methods of proving service). 

    £600 plus VAT and Court fee (£593)

     

    Respondent to uncontested Divorce Proceedings

     

    Completing and filing the Form of Acknowledgement, monitoring progress of divorce and providing key date updates through to Final Order (excludes applications within proceedings e.g. costs). 

    £400 plus VAT

     

    Financial Consent Application – drafting on behalf of Applicant

     

    Only available on the basis that agreement has been reached and set out in a Memorandum of Agreement, includes dealing with one request for amendment and submitting to the court for approval.  Providing and assisting with the self-completion of a Statement of Information, subject to availability of all necessary financial information (excludes pension sharing, see below). 

    £1000 plus VAT and Court fee (£53)

     

    Pension sharing

     

    To include the drafting, advising and assisting with completion of a Pension Sharing Annex, up to a maximum of two.  Including service of notice on Pension Trustee pre Order and post Order, subject to being provided with the Decree Absolute of Divorce. 

    £200 plus VAT

    Financial Consent Application- Reviewing on behalf of Respondent

     

    Explanation as to provisions and implications of the draft Order (excludes specific legal advice as to whether the terms are fair in your circumstances for which you will be asked to sign a Disclaimer).  Includes generic advice as to entitlement and assistance as to the completion of the detailed Statement of Information form, if provided. 

    £500 plus VAT

    Adult change of Name Deed

     

    Preparing draft Change of Name Deed for one person with all necessary consents. To include letter of authenticity where required and an additional certified copy. Please enquire for charges in relation to Change of Name Deeds for children.

    £200 plus VAT

     

    Court Fees

    The majority of applications before the Court in England and Wales will be subject to a fee payable applicable at the time of filing. Fees are subject to change by the Court and current fee details are detailed above, however, at the time they are payable, may have increased.

    Other disbursements

    Birchall Blackburn Law’s policy is to carry out a comprehensive identification anti-money laundering check prior to instruction, charged at £4.00 plus VAT per individual.

    When dealing with financial consent applications, where there is property involved to download a copy of the register of title from the land registry at £3.00 per title.

    Fixed Fee Terms and Conditions

    1. Payment to be made upon agreeing terms of business by debit or credit card (excludes American Express);

    2. The fixed fee will remain payable in the event that the proceedings are suspended or withdrawn by the client. In the event that the proceedings are suspended or withdrawn by the opponent, assistance and representation may still be provided under the Family Department Teams’ normal terms of business with fees payable on an hourly rate (as per page 1 of the estimate of charges herein).
