    A good time to think about a Will?

    Now is a good time to do some life admin and get a Will.

    Owning a property is one of the biggest investments you’ll ever make and it increases your assets significantly. While remortgaging many of our clients also take the time to sort out a Will.

    What happens to my home, money and other assets if I don’t have a Will? When someone dies without making a Will, their assets are shared according to the Rules of Intestacy.     • Do I need a conveyancing solicitor when remortgaging?

      You don’t always need a solicitor if you are thinking of remortgaging. If you’re borrowing more on your existing mortgage deal with your lender then there are no legal cost, but remember you will have fees relating to the increased loan and repayments.

      If you choose to remortgage with your current lender it is called a ‘product transfer’ – moving to a new rate or deal – and legal work is required.

      But in other circumstance you will need a solicitor or conveyancer to help guide you through the legal side of remortgaging.

    • When will I need a conveyancer or solicitor to remortgage?

      If you are in doubt, you are always welcome to get in touch with us to discuss whether you need a solicitor or conveyancer’s help. We can talk to you in confidence and with no obligations.

      There are usually a couple of situations when you will need legal assistance to remortgage. You’ll need to get a solicitor if you are changing the ownership of the property, for example if you are adding a friend or partner to your mortgage. Or if you are removing someone from the mortgage.

      In these cases a solicitor or conveyancer will amend the deeds and draw up paperwork to specify how you will own the property, which is known as a ‘transfer of equity’.

       

       

    • How long does a remortgage take?

      You should leave up to 3 months to remortgage, although it can be much quicker depending on the circumstances.
